Website Terms and Conditions

akchurina.com (the “Website”) is the personal website of Marina Akchurina. I operate it as an individual. Your access to and use of the Website constitutes your acceptance of, and is conditional upon your compliance with, these Terms and Conditions. If you do not agree with them, please do not use the Website.

The Website introduces my two practices, each of which is a separate entity:

ArbitraLex Professional Corporation (“ArbitraLex”), my law practice, regulated by the Law Society of Ontario (arbitralexlegal.com).

Akchurina Consulting and Soft Solutions Ltd. (“AksConsult”), my consulting practice, which provides negotiation consulting, corporate training, and arbitrator and mediator services (aksresolution.com). These are not legal services.

These Terms and Conditions apply only to the Website. When you visit arbitralexlegal.com or aksresolution.com, the terms published on that website apply.

1. No Lawyer-Client or Service Relationship

Your access to or use of the Website, booking a meeting through the Website, or attending an introductory meeting with me does not create a lawyer-client, professional, advisory, fiduciary, or other service relationship.

Legal services are provided only by ArbitraLex. A lawyer-client relationship with ArbitraLex arises only when ArbitraLex confirms it has no conflict of interest and you and ArbitraLex sign a written retainer.

AksConsult provides consulting, training, and arbitrator and mediator services only under a written service agreement signed by you and AksConsult.

2. Introductory Meetings

The Website allows you to book a free introductory meeting with me. The purpose of the meeting is to understand your situation and whether ArbitraLex or AksConsult can assist you. An introductory meeting is not a consultation, and I do not give legal or other professional advice during it.

I may decline, reschedule, or cancel any booking at my discretion, including where a conflict of interest may exist or where the request falls outside the services of either practice.

3. Not Legal or Professional Advice

The information on the Website, and in any materials to which it links (collectively, the “Content”), is for general information purposes only. The Content is not legal advice or professional advice of any kind, and it may not be used for professional or commercial purposes.

No one should act, or refrain from acting, based solely on the Content without first obtaining appropriate advice from a qualified professional retained to advise them. Content is current only as of its publication date, and I assume no responsibility for updating it.

4. Communications Not Confidential

Do not send confidential information, details of your matter, or documents through the Website, including in the booking form, or by email. Information sent this way is not secure and will not be treated as confidential until the appropriate engagement with ArbitraLex or AksConsult is in place.

5. Disclaimer of Warranties

While I make reasonable efforts to keep the Content accurate and current, I do not warrant or guarantee the accuracy, currency, reliability, or completeness of the Content; that the Website will be available without interruption, error, or omission; that defects will be corrected; or that the Website and the servers that make it available are free from viruses or other harmful components.

The Website and all Content are provided on an “as is” and “as available” basis, without representations, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. All such warranties are expressly disclaimed to the fullest extent permitted by law.

6. Limitation of Liability

To the fullest extent permitted by law, I will not be liable for any loss, cost, or damages whatsoever (including damages for harm to business, loss of profits, programs or data, interruption of activities, or any other pecuniary or economic loss), whether direct, indirect, incidental, punitive, special, exemplary, consequential, or otherwise, arising out of any use of, reliance upon, or misuse of the Website or the Content, or any defects, inaccuracies, errors, or omissions in the Website or the Content, regardless of the form of action, even if I have been advised of the possibility of such damages.

Your use of the Website and reliance on the Content is entirely at your own risk.

7. Limited Licence

The Content is owned by me unless otherwise indicated. ArbitraLex and AksConsult own their names, logos, and trademarks.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Website and to display or print individual pages for your personal, non-commercial use, provided that you do not modify the Content and you keep all copyright and other proprietary notices. You may not otherwise copy, reproduce, republish, transmit, modify, distribute, publicly display, create derivative works from, or commercially exploit the Website or any Content without my prior written permission.

8. Links to Other Websites

The Website contains links to other websites, including arbitralexlegal.com, aksresolution.com, and social media platforms. Links to third-party websites are provided for your convenience. I am not responsible for the content, accuracy, or availability of third-party websites, and a link does not imply my endorsement of the linked website or its content. Your use of any linked website is subject to that website’s own terms and privacy policy.

9. Governing Law and Jurisdiction

These Terms and Conditions, and your use of the Website, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario sitting in the City of Toronto for the resolution of any dispute arising out of or relating to these Terms and Conditions or your use of the Website.

10. Changes to These Terms and Conditions

I may update these Terms and Conditions from time to time. Changes take effect when posted on the Website, and the date below will show when they were last updated. Your continued use of the Website after changes are posted constitutes your acceptance of the updated Terms and Conditions.

11. Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

12. Entire Agreement

These Terms and Conditions, together with the Privacy Notice, constitute the entire agreement between you and me relating to your use of the Website.
