Privacy Notice

This Privacy Notice explains how I, Marina Akchurina, collect, use, and disclose personal information through akchurina.com (the “Website”). The Website is my personal website. I operate it as an individual, and it is not operated by either of my practices.

The Website introduces my two practices, each of which is a separate entity with its own website and its own privacy policy:

ArbitraLex Professional Corporation (“ArbitraLex”), my law practice, regulated by the Law Society of Ontario (arbitralexlegal.com). ArbitraLex provides legal services only under a written retainer.

Akchurina Consulting and Soft Solutions Ltd. (“AksConsult”), my consulting practice, which provides negotiation consulting, corporate training, and arbitrator and mediator services (aksresolution.com). These are not legal services.

This Privacy Notice applies only to the Website. When you visit arbitralexlegal.com or aksresolution.com, the privacy policy published on that website applies.

By using the Website or submitting personal information through it, you consent to the collection, use, and disclosure of your personal information in accordance with this Privacy Notice. If you do not agree with this Privacy Notice, please do not use the Website. You may give express consent orally, electronically, or in writing. Implied consent is consent that can reasonably be inferred from your action or inaction. For example, when you book a meeting through the Website, I will assume your consent to collect, use, and disclose your personal information for the purposes identified in this Privacy Notice.

If you provide me with personal information of another individual, you represent that you have obtained all necessary authority and consents from that person to enable me to collect, use, and disclose that information for the purposes set out in this Privacy Notice.

1. Information Collected Automatically

Technical Information

Like most websites, the Website automatically collects certain technical information about visitors. This may include the Internet Protocol (IP) address of your device, the date and time of your visit, the website from which you arrived, your browser and operating system, and the sections of the Website you view. I use this information for Website administration, security, trend analysis, and improving the Website. I may aggregate it with information about other visitors and disclose it to third parties in aggregate form that does not identify you.

Cookies

The Website uses “cookies,” small data files stored on your device when you visit. Cookies allow the Website to recognize your device and remember certain settings.

You may decline cookies through your browser settings, but doing so may affect certain Website features, including booking a meeting.

Google Analytics

The Website uses Google Analytics, a web analytics service provided by Google LLC, to understand how visitors use the Website, including the number of visitors, the sections they view, and how long they stay. I use this information to analyze Website traffic and improve the Website. Google transmits and stores information collected by Google Analytics on servers that may be located outside Canada.

If you wish to opt out of Google Analytics, you may install the Google Analytics Opt-out Browser Add-on available at: https://tools.google.com/dlpage/gaoptout

2. Personal Information You Provide

Booking an Introductory Meeting

The Website allows you to book a free introductory meeting with me through a booking system built into the Website (LatePoint). When you book, you will be asked to provide your first name, last name, email address, and mobile phone number, together with a brief description of what you would like to discuss at the meeting. This description should not include confidential or sensitive information (see below). I store your booking on the Website, add it to my Microsoft Outlook calendar, and create a Zoom link for the meeting. I use this information to schedule the meeting, prepare for it, and understand which of my practices, if any, can help you.

Booking a meeting does not create a lawyer-client relationship with ArbitraLex, or a service relationship with AksConsult. A lawyer-client relationship arises only when ArbitraLex has confirmed that it has no conflict of interest and a written retainer has been signed.

Please do not include confidential or sensitive information when booking a meeting, such as details of a dispute, the names of other parties, or documents. Information sent through the booking form is not secure and will not be treated as confidential until the appropriate engagement is in place.

Newsletter

The Website contains a link to aksresolution.com, where you can subscribe to AksConsult Insights, a newsletter published by AksConsult. The Website itself does not collect any information for the newsletter. If you subscribe, you do so on aksresolution.com, and AksConsult handles your subscription in accordance with the privacy notice published there.

Contacting Me

If you write to me about this Privacy Notice or your personal information, I will collect your name, email address, and the content of your message, and use them to respond to you.

3. Use of Your Personal Information

I may use your personal information for the following purposes:

(a) to schedule and prepare for introductory meetings and to communicate with you;

(b) to understand whether ArbitraLex or AksConsult can assist you;

(c) to understand which channels bring visitors to the Website, and to improve the Website;

(d) to detect and protect against fraud, security threats, and other unlawful activity;

(e) to comply with legal or regulatory obligations; and

(f) for any other purpose to which you have consented.

If, after our introductory meeting, you engage ArbitraLex or AksConsult, the practice you engage will hold the information needed for that engagement, and its own privacy policy and the terms of the engagement will apply from then on.

4. Disclosure of Your Personal Information

I do not sell, rent, or trade your personal information. I may disclose your personal information in the following circumstances:

(a) with your consent;

(b) to ArbitraLex or AksConsult, where needed for the practice you choose to engage, as described in Section 3;

(c) to service providers who help me operate the Website and hold meetings, including GoDaddy (website hosting), Google LLC (analytics), Microsoft (calendar), and Zoom Video Communications (video meetings), provided they agree to protect the information and use it only to provide their services;

(d) if required by law, court order, subpoena, or other legal process;

(e) to a government institution that has asserted lawful authority to obtain the information, or where I have reasonable grounds to believe the information could be useful in the investigation of unlawful activity;

(f) to protect the rights, property, or safety of myself or others; or

(g) as otherwise permitted or required by applicable law.

I may use or disclose your personal information without your knowledge or consent where permitted or required by applicable law.

5. Storage, Security, and Transfers Outside Canada

I take reasonable steps to safeguard your personal information using methods appropriate to its sensitivity. However, no transmission of data over the Internet is completely secure, and I cannot guarantee that personal information will be protected against loss, misuse, interception, or alteration. If you become aware of any loss of, or unauthorized access to or disclosure of, personal information in my custody or control, please let me know immediately.

Your personal information may be stored and processed in Canada, the United States, or other jurisdictions where my service providers maintain facilities. Those jurisdictions may have data protection laws that differ from those where you live, and your information may be disclosed in response to valid demands or requests from governments, regulators, courts, and law enforcement authorities there. By using the Website and providing your personal information, you consent to these transfers.

6. Access to Your Personal Information

You may request access to the personal information I hold about you and ask me to correct any information that is inaccurate or incomplete. To do so, please contact me at the address in Section 11. I will respond within a reasonable time and in accordance with applicable privacy laws.

7. Withdrawal of Consent

You may withdraw your consent to the collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice, by contacting me at the address in Section 11. If you withdraw your consent, I may not be able to schedule a meeting with you or respond to your request.

8. Retention of Personal Information

I retain personal information only for as long as necessary to fulfil the purposes for which it was collected, to comply with legal obligations, to resolve disputes, and to enforce agreements. If an introductory meeting does not lead to an engagement, I keep the booking information only for as long as reasonably needed for these purposes.

9. Links to Other Websites

The Website contains links to other websites, including arbitralexlegal.com, aksresolution.com, and social media platforms such as LinkedIn. This Privacy Notice does not apply to those websites. ArbitraLex and AksConsult each publish their own privacy policy on their website, and third-party platforms have their own policies. I encourage you to review the privacy policy of any website you visit.

10. Changes to This Privacy Notice

I may update this Privacy Notice from time to time. Changes take effect when posted on the Website, and the date below will show when the Notice was last updated. By continuing to use the Website after changes are posted, you accept the updated Privacy Notice. I encourage you to review it periodically.
